Terms of Use

End-User License Agreement

Welcome to TruuBlue, operated by TruuBlue LLC (“us,” “we,” the “Company” or “TruuBlue”).

Notice to California subscribers: You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the third business day following the date you subscribed. If you subscribed using your Apple ID, refunds are handled by Apple, not TruuBlue. If you wish to request a refund, please visit getsupport.apple.com. If you subscribed using your Google Play Store account or through TruuBlue Online, contact customer support.

1. Acceptance of Terms of Use Agreement

By creating a TruuBlue account or by using any TruuBlue service, whether through a mobile device, mobile application, or computer (collectively, the “Service”) you agree to be bound by these Terms of Use, our Privacy Policy, Cookie Policy, Arbitration Procedures, Safety Tips, Community Guidelines, and any terms disclosed to you if you purchase additional features, products, or services.

If you do not accept and agree to be bound by all the terms of this Agreement, you should not use the Service.

We may make changes to this Agreement and to the Service from time to time. The most recent version will be posted on the Service on TruuBlue.com, and the most recent version is the version that applies. If the changes include material changes to your rights or obligations, we will notify you in advance when required.

2. Eligibility

You must be at least 18 years of age to create an account on TruuBlue and use the Service. By creating an account and using the Service, you represent and warrant that:

  • You can form a binding contract with TruuBlue.
  • You are not barred from using the Service under the laws of the United States or any other applicable jurisdiction.
  • You will comply with this Agreement and all applicable local, state, national, and international laws, rules, and regulations.
  • You have never been convicted of or pled no contest to a felony, a sex crime, or any crime involving violence, and you are not required to register as a sex offender.

3. Your Account

To use TruuBlue, you may sign in in several ways, including by telephone number, Apple login, or Facebook login. If you choose to use your Facebook login, you authorize us to access and use certain Facebook account information, including your public Facebook profile.

You are responsible for maintaining the confidentiality of your login credentials and are solely responsible for all activities that occur under those credentials. If you think someone has gained access to your account, please immediately contact us.

4. Modifying the Service and Termination

TruuBlue may add, remove, suspend, or modify features of the Service from time to time. If these actions do not materially affect your rights or obligations, we may not provide advance notice.

You may terminate your account at any time through the instructions in Settings in the Service. If you use a third-party payment account, you must manage in-app purchases through that provider to avoid additional billing.

TruuBlue may terminate your account at any time without notice if it believes you have violated this Agreement. Upon such termination, you may not be entitled to any refund for purchases.

5. Safety; Your Interactions with Other Members

Though TruuBlue strives to encourage a respectful member experience, TruuBlue is not responsible for the conduct of any member on or off the Service. You agree to use caution in all interactions with other members, particularly if you decide to communicate off the Service or meet in person.

You agree not to provide your financial information, or wire or otherwise send money, to other members.

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. YOU UNDERSTAND THAT TRUUBLUE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS OR OTHERWISE INQUIRE INTO THE BACKGROUND OF ITS MEMBERS.

TruuBlue reserves the right to conduct criminal background checks or other screenings at any time using available public records or with the assistance of a consumer reporting agency.

6. Rights TruuBlue Grants You

TruuBlue grants you a personal, worldwide, royalty-free, non-assignable, nonexclusive, revocable, and non-sublicensable license to access and use the Service for your personal use.

You agree not to:

  • Use the Service or its content for commercial purposes without written consent.
  • Copy, modify, transmit, or create derivative works from Service content without consent.
  • Use bots, scrapers, crawlers, spiders, or automated tools to access the Service.
  • Interfere with, disrupt, or negatively affect the Service or connected networks.
  • Upload viruses or malicious code or otherwise compromise Service security.
  • Frame or mirror any part of the Service without authorization.
  • Reverse engineer, decompile, or disassemble any portion of the Service.
  • Use or publish the TruuBlue API without written consent.
  • Probe, scan, or test the vulnerability of the Service or related systems.
  • Encourage or promote activity that violates this Agreement.

7. Rights You Grant TruuBlue

By creating an account, you grant to TruuBlue a worldwide, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute information you authorize us to access from third parties, as well as any information or content you post on the Service or transmit to other members.

This license is for the limited purpose of operating, developing, providing, and improving the Service and researching and developing new ones, subject to your rights under applicable law.

You agree that all information you submit is accurate and truthful and that you have the right to post the content and grant the license described above.

We may monitor or review content you post and may delete content that violates this Agreement or may harm the reputation of the Service.

8. Community Rules

By using the Service, you agree that you will not:

  • Use the Service for any illegal or prohibited purpose.
  • Use the Service for any harmful or nefarious purpose.
  • Damage or attempt to damage TruuBlue.
  • Violate Community Guidelines.
  • Spam, solicit money from, or defraud members.
  • Impersonate any person or entity.
  • Bully, stalk, intimidate, harass, or defame any person.
  • Post content that violates privacy, publicity, copyright, trademark, or other rights.
  • Post hate speech, threatening, sexually explicit, or pornographic content.
  • Promote racism, bigotry, hatred, or physical harm.
  • Solicit passwords or personal identifying information for unlawful purposes.
  • Use another user’s account, share accounts, or maintain more than one account.
  • Create another account if we have already terminated your account without permission.

TruuBlue reserves the right to investigate and/or terminate your account without a refund if you violate this Agreement, misuse the Service, or behave in an inappropriate or unlawful way.

9. Child Sexual Abuse and Exploitation (CSAE) Standards

TruuBlue has a zero-tolerance policy for any content or behavior involving child sexual abuse and exploitation. Any violation may result in immediate account termination and, where appropriate, reporting to law enforcement and relevant child protection agencies.

We provide an accessible and confidential reporting system for suspicious content or behavior and may collaborate with law enforcement, NCMEC, and technology partners to combat CSAE.

10. Other Members’ Content

Although TruuBlue reserves the right to review and remove content that violates this Agreement, such content is the sole responsibility of the member who posts it. If you see content that violates this Agreement, please report it within the Service or via our contact form.

11. Purchases

Generally

TruuBlue may offer products and services for purchase through the App Store, Google Play Store, carrier billing, TruuBlue direct billing, or other authorized payment platforms.

Auto-Renewal

If you purchase an auto-recurring subscription, your payment method will continue to be billed until you cancel. Deleting your account or deleting the app does not cancel your subscription.

Direct Billing

If you pay TruuBlue directly, TruuBlue may correct billing errors and may terminate your account if you initiate a chargeback or reverse a payment.

Virtual Items

Virtual items may be offered for use within the Service. These items do not have real-world value, are non-transferable, and all purchases and redemptions of virtual items are final and non-refundable.

Refunds

Generally, all charges are nonrefundable, and there are no refunds or credits for partially used periods, except where required by law or where TruuBlue makes an exception.

Subscribers residing in Arizona, California, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, and Wisconsin may cancel a subscription without penalty before midnight of the third business day following subscription.

To request a refund:

  • Apple ID purchases: request through Apple at getsupport.apple.com.
  • Google Play or direct TruuBlue purchases: contact customer support with your order number.

Pricing

Pricing may vary by region, subscription length, bundle size, promotions, and feature testing.

12. Notice and Procedure for Making Claims of Copyright Infringement

If you believe that your work has been copied and posted on the Service in a way that constitutes copyright infringement, please submit a takedown request using the designated form.

Your notice should include:

  • An electronic or physical signature of the authorized copyright owner or agent.
  • A description of the copyrighted work claimed to have been infringed.
  • A description of where the allegedly infringing material is located on the Service.
  • Your contact information.
  • A statement that you have a good-faith belief the disputed use is not authorized.
  • A statement, under penalty of perjury, that the information in your notice is accurate.

TruuBlue will terminate the accounts of repeat infringers.

13. Disclaimers

TRUUBLUE PROVIDES THE SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS AND, TO THE EXTENT PERMITTED BY APPLICABLE LAW, GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TruuBlue does not represent or warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any content or information obtained through the Service will be accurate.

TruuBlue takes no responsibility for any conduct of you or any other member, on or off the Service.

14. Third-Party Services

The Service may contain advertisements, promotions, and links to third-party websites or resources. TruuBlue is not responsible for the availability, terms, or actions of such third parties.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRUUBLUE, ITS AFFILIATES, EMPLOYEES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE, OR ENHANCED DAMAGES.

In no event shall TruuBlue’s aggregate liability to you for claims arising out of or relating to the Service or this Agreement exceed the amount paid, if any, by you to TruuBlue during the twenty-four (24) month period immediately preceding the date you first file a legal proceeding against TruuBlue.

Some jurisdictions do not allow certain exclusions or limitations, so some of these limitations may not apply to you.

16. Arbitration, Class-Action Waiver, and Jury Waiver

Except where prohibited by applicable law, the exclusive means of resolving disputes or claims arising out of or relating to this Agreement or the Service shall be binding arbitration administered by JAMS under the applicable rules, except as modified by TruuBlue’s Arbitration Procedures.

Either party may bring an individual claim in small claims court where eligible. However, you agree that you will not under any circumstances commence, maintain, or participate in any class action, class arbitration, or other representative action against TruuBlue.

By accepting this Agreement, both you and TruuBlue give up the right to go to court to assert or defend most claims and also give up the right to participate in a class action or other class proceeding.

17. Governing Law and Venue

To the extent permitted by applicable law and except as otherwise stated in the arbitration provisions, this Agreement and your relationship with TruuBlue shall be governed by the laws specified in the full Terms of Use, without regard to conflict of law rules.

18. Indemnity by You

You agree, to the extent permitted under applicable law, to indemnify, defend, and hold harmless TruuBlue, our affiliates, and their officers, directors, agents, and employees from and against any complaints, demands, claims, damages, losses, costs, liabilities, and expenses arising out of your access to or use of the Service, your content, or your breach of this Agreement.

19. Entire Agreement and Other Terms

These Terms, together with the Privacy Policy, Cookie Policy, Safety Tips, Community Guidelines, Arbitration Procedures, and any additional terms presented to you, constitute the entire agreement between you and TruuBlue regarding your use of the Service.

If any provision of this Agreement is held invalid, the remainder will continue in full force and effect.
